Welcome to Mooky. These Terms of Use govern your use of the Mooky mobile application and related services.

By creating an account, using the app, or accessing the service, you confirm that you have read and agree to these Terms of Use and Mooky’s Privacy Policy. If you do not agree to these terms, do not use the app.

1. Purpose of the service

Mooky is an app for parents, legal guardians, and caregivers that helps track a baby’s routine, including sleep, feeding, diapers, insights, reminders, AI chat, and community chat.

Mooky is intended to help organize information, track routines, and provide general insights. It is not a medical device, is not intended for diagnosis, treatment, prevention, or medical monitoring, and does not replace a doctor, nurse, certified consultant, medical hotline, or any other professional.

In any case of medical concern, emergency, unusual change in the baby’s condition, fever, breathing difficulty, signs of dehydration, unusual lethargy, unusual crying, feeding problems, or any other doubt, you should contact a qualified medical professional.

2. Who may use the app

Mooky is intended for parents, legal guardians, and caregivers who are at least 18 years old. The app is not intended for direct use by children, and children may not create accounts.

When using the app in relation to a baby, you represent that you have the legal authority or appropriate consent to enter information about that baby and manage tracking for that baby in the app.

3. Account creation and sign-in

To use Mooky, you must create an account and sign in using Google or Apple. You may not use another person’s account or share your access credentials with anyone who is not authorized.

You are responsible for maintaining the security of your account and for all activity that occurs through it. If you suspect unauthorized use of your account, contact us at support@getmooky.com.

4. Baby profile and caregivers

In the current version, each account may be linked to one baby profile, and each Baby includes up to two caregivers. Each caregiver must sign in through their own personal Google or Apple account.

Access to a baby’s information is granted only to users who have been invited or approved as caregivers for that Baby. Support for more than two caregivers may be added in the future.

You are responsible for inviting only caregivers who have appropriate authorization to view and update information about the baby.

5. Subscription, free trial, and payment

The app is free to download, but active use of the service may require an auto-renewing subscription through the Apple App Store or Google Play.

Mooky may offer monthly and annual subscription plans, as well as a 7-day free trial. Prices, subscription terms, and renewal details are displayed in the app and in the relevant app store before purchase.

The subscription is intended to apply at the Baby/Family level, and not necessarily only at the individual user level. In the current version, an active subscription for a Baby enables use within the two caregivers included for that Baby.

Payments, renewals, cancellations, and refunds are managed by Apple or Google, depending on the platform through which the purchase was made. To cancel a subscription, you must do so through your Apple App Store or Google Play subscription settings, and not merely by deleting the app from your device.

After the end of a free trial, cancellation, or expiration of an active subscription, Mooky may switch to read-only mode, where you may view existing information but cannot add new events, use the AI chat, publish in the community, or use certain active features.

Mooky may update subscription structures, prices, included features, trial periods, or usage limits from time to time, subject to applicable law and Apple and Google rules.

6. Permitted use of the app

You agree to use Mooky lawfully, reasonably, and in accordance with these terms.

You may not use the app to:

• violate any law, regulation, or third-party right;
• enter information that you are not authorized to provide;
• publish abusive, threatening, harassing, defamatory, sexual, violent, discriminatory, or unlawful content;
• publish dangerous or misleading medical information, or content that may cause others to avoid seeking medical care;
• publish personally identifying information about another person without authorization;
• perform scraping, reverse engineering, intrusion attempts, bypass security measures, or unauthorized automated use;
• harm the operation of the service, servers, other users, or Mooky’s reputation;
• use the app for unauthorized commercial purposes.

7. AI Chat

Mooky includes an AI chat that provides general information, explanations, and insights in the context of the baby’s routine. The chat may take into account information entered in the app, such as the baby’s age and sleep, feeding, and diaper events.

Use of the AI chat is limited to 25 messages per user per day, or another limit displayed in the app from time to time.

The chat is not a medical service and does not replace professional judgment. You should not rely on it for diagnosis, treatment, medical decisions, emergencies, or any situation where a professional is required.

Mooky may limit, refuse to answer, display a warning, or refer users to professional help where a question relates to medical, safety, urgent, dangerous, or sensitive topics.

AI responses may be inaccurate, incomplete, outdated, or unsuitable for your specific circumstances. Use of AI responses is at your own responsibility.

8. Community chat and user-generated content

Mooky includes a community chat where users may publish questions, posts, comments, likes, age ranges, and optional hashtags.

Community content is published anonymously to other users, but not fully anonymously as between you and Mooky. We may keep internal identifiers that allow content to be linked to the user account that published it, for purposes such as safety, community management, handling reports, preventing abuse, and enforcing these terms.

You are responsible for all content you publish in the community. You may not publish:

• personally identifying information about yourself, the baby, or another person;
• sensitive medical information that you do not want disclosed;
• content that constitutes dangerous or misleading medical advice;
• abusive, harassing, violent, sexual, discriminatory, defamatory, or unlawful content;
• advertising, spam, or unauthorized commercial promotion;
• content that infringes copyrights, trademarks, privacy, or other rights;
• content that may endanger babies, children, parents, or other users.

Mooky may, at its discretion, remove or hide content, restrict accounts, suspend users, block access to the community, handle reports, or take additional actions, including without prior notice, if there is concern of a violation of these terms, harm to other users, a safety risk, or misuse.

Users may be able to delete posts or comments they published, subject to technical limitations and the need to maintain continuity of community discussions.

9. License to user content

When you publish content in Mooky, including in the community chat or AI chat, you grant Mooky a non-exclusive, worldwide, royalty-free license to use, store, display, process, copy, publish, reformat, remove, or anonymize that content as needed to operate the service, display the content, manage the community, maintain security, provide support, improve the service, and enforce these terms.

This does not take away your rights in original content you created, to the extent you have such rights.

10. Reports, blocking, and community management

Mooky may allow users to report content or users, hide content, or block content from certain users. Even if these mechanisms are not fully available at every stage, Mooky may handle complaints and reports through support or internal tools.

11. Privacy

Your use of Mooky is also subject to our Privacy Policy, which explains what types of information we collect, how we use it, who we share it with, and how you can request account or data deletion.

12. Account deletion

You may request account deletion from the settings screen in the app.

Account deletion will delete or anonymize the personal information associated with the account, in accordance with the Privacy Policy. Community content published anonymously may remain visible without active identification of the user, in order to maintain continuity of community discussions, unless Mooky decides to remove it or is required by law to do so.

Deleting the app from your device does not necessarily cancel an active subscription. Subscription cancellation must be handled through the Apple App Store or Google Play.

13. Service availability and changes

Mooky may change from time to time. We may add, modify, limit, suspend, or remove features, content, screens, notifications, usage limits, subscription models, or parts of the service.

We do not guarantee that the service will be available at all times, uninterrupted, error-free, or without disruptions. Temporary interruptions may occur due to maintenance, updates, technical issues, third-party provider limitations, or circumstances beyond our control.

14. Intellectual property

Mooky, including the app name, design, interface, logo, illustrations, text, code, features, algorithms, service structure, and other content that is not user content, is owned by Mooky or by third parties that have authorized Mooky to use it.

You may not copy, modify, distribute, sell, reproduce, reverse engineer, create derivative works from, or use any part of the service without prior written permission, unless expressly permitted by law.

15. Third-party services and providers

Mooky relies on third-party services to operate parts of the service, such as Google, Apple, OpenAI, infrastructure providers, notification providers, and app store providers.

We are not responsible for the policies, availability, errors, changes, or actions of third-party providers. Your use of third-party services may also be subject to their terms and policies.

16. Disclaimer of warranties

Mooky is provided “as is” and “as available.” Subject to applicable law, we do not warrant that the app will be accurate, complete, suitable for your needs, always available, error-free, or that results from using it will meet your expectations.

Insights, predictions, summaries, reminders, and AI responses are assistance tools only. They may be incorrect, incomplete, or unsuitable for the specific circumstances of your baby.

17. Limitation of liability

Subject to applicable law, Mooky, its owner, employees, representatives, providers, and partners will not be liable for indirect, special, consequential damages, loss of data, loss of profits, harm to reputation, or any other damage arising from the use of, or inability to use, the app.

Nothing in these terms limits liability that cannot be limited under applicable law.

18. Suspension or termination of access

Mooky may suspend, restrict, or terminate your access to the app or parts of it if there is concern that you violated these terms, acted dangerously or abusively, harmed other users, attempted to bypass limitations, or misused the service.

19. Governing law and jurisdiction

These terms are governed by the laws of the State of Israel, without giving effect to conflict-of-law rules. Any dispute arising from these terms or from the use of Mooky will be heard in the competent courts in Israel, unless applicable law requires otherwise.

20. Changes to these terms

We may update these Terms of Use from time to time. If we make a material change, we will take reasonable steps to notify users, such as through an in-app notice or other appropriate means.

Continued use of the app after an update means that you accept the updated terms, to the extent permitted by applicable law.
